In summary, your acceptance of this Purchase Agreement is your declaration to PrivSecure that the Products will only be used in a lawful manner, and you agree to take full responsibility for how you use the Products and Services and waive any liability from PrivSecure. We have a duty of care to ensure that our customers will use our Products and Services in a lawful and peaceful manner.

We would also like to advise you that by purchasing these goods and/or services, you agree that any devices, software, platform and/or any other service or product (the “Products”) provided to you by PrivSecure will only be used by you (or by anyone on your behalf) in a manner that complies with all applicable laws, restrictions and regulations in the jurisdiction in which you use the Products. This includes, but is not limited to, applicable restrictions concerning the protection of privacy and intellectual property (including copyrights and any other intellectual property rights), anti-money laundering laws, anti-corruption laws, anti-drug laws, criminal laws etc., and you shall be responsible for any unlawful use of the products by you and/or anyone on your behalf.

Further, you agree that you and anyone on your behalf, will not use the Products in any manner which is, or in any way may be, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libellous, indecent, invasive of another’s privacy, hateful, or racially or ethnically objectionable, including the:

  • exploitation of children in any way, including audio, video, photography, digital content, etc.
  • violation, infringement, or misappropriation of other people’s intellectual property, privacy or other legal rights; and
  • sharing of anything that is illegal, abusive, harmful or harassing.

By purchasing our products, you agree to accept our Terms & Conditions. Some parts of the products & services are in early development and may be missing features or experience errors. We appreciate your support and will continue to invest in putting people-before-profit, and continuing R&D for future digital privacy endeavours.

To the fullest extent permitted by law, I (“Customer”) and each of its employees, agents and invitees, waive any and all claims and rights against PrivSecure, the parent company and PrivSecure’s Indemnified Parties arising from injury to or damage to, or destruction, theft or loss of property or person. PrivSecure and the parent company and its affiliates shall not be liable under any cause of action for any indirect, special, incidental, consequential or punitive damages, including loss of profits or business interruption. The aggregate monetary liability of PrivSecure and its affiliates to Customer and each of its employees, agents and invitees for any reason and for all causes of action, shall not exceed the total fees paid to PrivSecure hereunder. The Customer acknowledges that it may be necessary to install certain software onto its computer(s), mobile phone(s), and/or other electronic devices in order to utilize all of the services or functionalities available from the Products and Services provided by PrivSecure. The Customer agrees that PrivSecure and its affiliates are not responsible for any damage to the Customer’s computers or other electronic devices relating to such software or any technical support provided by PrivSecure or its affiliates, and that Customer assumes any liability in the event that such software interferes or otherwise adversely affects such computers or other electronic devices. PrivSecure and its affiliates expressly disclaim any verbal or written warranties, express or implied, with respect to such software or any technical support provided to the Customer. The Customer agrees that PrivSecure and its affiliates are not responsible for any unlawful use of the Products and Services, and that Customer assumes full liability in the event that any illegal use is conducted while using the Product(s) and/or Services(s).

We do not take responsibility for your irresponsible or illegal misuse of our products. While we trust in the privacy and security features of our products, you are responsible for safe usage of the Product Devices & Cloud Services.
